David advises clients on the development and implementation of global trademark portfolio and enforcement strategies. He oversees a worldwide network of associates and coordinates their efforts to secure and protect trademark assets. He also advises on trademark selection and prosecution before the United States Patent and Trademark Office (USPTO) and, more generally, on how to reinforce the strength and value of their existing trademark assets.

David provides advice on how to safely and effectively put valuable intellectual property to good use. He drafts and negotiates agreements concerning creative content, trademarks, data and proprietary information. These often relate to the secure development of new and innovative goods and services.

David advises clients on laws,regulations and industry self-regulation applicable to advertising in traditional and new media. He helps to develop and launch promotional campaigns by preparing agreements with talent, creatives, publications, service providers and advertisers that allow clients to leverage high quality collateral,endorsements, influencers, spokespeople and events to reach their customers and promote their brands.

David assists clients in disputes and litigation concerning copyright, trademark and trade secret matters, as well as related contractual and commercial issues. These include trademark oppositions and cancellations before the USPTO’s Trademark Trial and Appeal Board (TTAB) as well as litigation in federal court. He has helped clients secure both favorable settlements and successful judgments that allow them to protect and make the most of their intellectual property assets without interference by infringers and bad faith litigants.

David works with the Winterfeldt IP Group’s cutting-edge Internet team to help clients maintain a secure presence on all levels of the domain name system (DNS). He handles domain name disputes involving the Internet Corporation for Assigned Names and Numbers(ICANN) Uniform Domain Name Dispute Resolution Policy (UDRP) and procedures specific to country-code top-level domains (ccTLDs). David advises clients on use of other ICANN rights protection mechanisms, such as the Uniform Rapid Suspension System (URS), Public Interest Commitment Dispute Resolution Procedure (PICDRP) and the Trademark Post-Delegation Dispute Resolution Procedure (PDDRP) applicable to some generic top-level domains (gTLDs). He also assists registry operators with the delegation, launch and maintenance ofgTLDs, including “.BRAND” gTLDs. David develops domain name portfolio strategies and enforcement programs, which includes advice on the use of the Trademark Clearinghouse (TMCH) and its attendant claims notice and new gTLD“sunrise” registration systems as well as registry operators’ voluntary rights protections mechanisms such as domains protected marks lists (DPML).
