Joseph Theis is an Associate with Winterfeldt IP Group. He supports Winterfeldt IP’s clients on a variety of U.S. and international trademark portfolio management matters, including conducting trademark clearance, and drafting, filing, and prosecuting trademark applications with the United States Patent and Trademark Office, as well as coordinating with international counsel for global trademark matters. Joseph also works on various trademark enforcement actions, including identifying instances of infringement, drafting cease and desist letters and takedown requests, initiating proceedings with the Trademark Trial and Appeal Board, participating in settlement negotiations through coexistence agreements, and preparing and executing additional enforcement strategies. Joseph also provides guidance on digital brand protection matters, including domain name portfolio management, domain name enforcement through UDRP proceedings, and other digital infringement reports. He has also participated in business development through client outreach and numerous written publications.
Joseph earned his JD from The Catholic University of America, Columbus School of Law, where he was a three-year recipient of the Father Michael Murray Scholarship. He also received a certificate of Intellectual Property Studies from the Law and Technology Institute at the Columbus School of Law, through which he gained extensive knowledge of trademark law, copyright law, and entertainment law. He also presented his thesis on international copyright law at CUA’s annual Research Day.
Joseph is also a notable published author through Georgetown University’s Creator Institute and New Degree Press, and has been published in World Trademark Review. His recent publications include analyses of significant Supreme Court cases concerning trademark and copyright rights, as well as the developing legal landscape concerning NFTs and other cutting-edge technologies.
