The United States Patent and Trademark Office issued its Final Rule Implementing the Trademark Modernization Act of 2020 on November 17, 2021. In a new World Trademark Review article, Brian Winterfeldt and David Rome discuss the key elements of the Final Rule as differing from the prior proposed rules that had been published for public comment in May 2021. These differences include the implementation of three-month Office action response periods; fees and procedures for ex parte cancellation proceedings; and attorney recognition provisions.
